Terms of Service

These Terms of Service describe the rules that apply when you access or use Finder. They cover our website, pre-launch access programs, hosted CRM product, APIs, and related services.

Please read them carefully. These terms are a general website and product framework, and a separate signed agreement with Finder may include additional or different terms for your organization.

Introduction

These Terms of Service govern your access to and use of Finder, including our website, applications, APIs, and related CRM services. By accessing or using Finder, you agree to these terms and to our Privacy Policy.

If you use Finder on behalf of a company or other entity, you represent that you have authority to bind that organization to these terms. In that case, "you" and "your" refer to both you and the organization.

If you do not agree to these terms, you may not access or use Finder.

Accounts and Eligibility

You must be at least 18 years old and legally able to enter into these terms to use Finder. You may not use Finder if doing so would violate applicable law or if your access has been suspended or terminated by Finder.

When you create an account, you agree to provide accurate, complete, and current information. You are responsible for safeguarding account credentials, managing user access inside your workspace, and ensuring that each user uses Finder only as authorized.

You must notify us promptly if you suspect unauthorized access to your account or workspace.

Communications

By creating an account or requesting access to Finder, you agree that we may send you service announcements, product updates, onboarding messages, newsletters, marketing communications, and promotional materials.

You may opt out of marketing or promotional communications by following the unsubscribe instructions in those messages or by contacting us. We may still send transactional, security, billing, legal, or service-related communications when needed to operate Finder or administer your account.

Purchases, Subscriptions, and Fees

Some parts of Finder may be offered on a paid subscription basis. If you purchase a paid plan, you agree to pay the fees and applicable taxes described in your order, invoice, or pricing page.

Subscriptions are billed in advance on a recurring basis unless your order or a separate written agreement states otherwise. At the end of each billing cycle, your subscription may renew automatically for the same term unless you cancel it or Finder cancels it.

You must provide accurate billing information and authorize Finder and its payment processors to charge the payment method you provide. If automatic billing fails, we may issue an invoice or suspend access until payment is received.

We may refuse or cancel an order at any time for reasons including product or service availability, errors in the description or price of a product or service, errors in your order, suspected fraud, an unauthorized or illegal transaction, or other legitimate business or legal reasons.

Finder may change subscription fees prospectively with reasonable notice. Your continued use after a fee change takes effect means you agree to pay the updated fees.

Trials, Promotions, and Refunds

Finder may offer trials, beta access, discounts, contests, sweepstakes, or other promotions. Additional rules may apply to those programs, and those rules will control if they conflict with these terms.

If a trial requires billing information, you may be charged at the end of the trial unless you cancel before the trial expires. Finder may modify or end trial offers at any time.

Except where required by law or expressly stated in a separate agreement, fees are non-refundable and cancellation takes effect at the end of the current billing period.

Customer Data

You retain ownership of the data, records, files, and other content you submit to Finder. You grant Finder the limited rights needed to host, process, transmit, search, back up, and display that data solely to provide and support the service.

You are responsible for the legality, accuracy, and quality of customer data submitted to Finder, including obtaining any required consents and providing any required notices to your own contacts, employees, or end users.

Finder does not claim ownership of customer data and will handle it according to these terms, our Privacy Policy, and any applicable written data processing agreement.

Data Export and Deletion

During an active subscription, workspace administrators may export or delete customer data using available product features or by contacting Finder.

After termination or cancellation, Finder may retain customer data for a limited period to support account recovery, legal compliance, security, fraud prevention, dispute resolution, and backup retention. After that period, customer data may be deleted or de-identified unless a separate written agreement requires otherwise.

Deleted data may persist in backups for a limited time until those backups are overwritten according to our normal retention practices.

Content and Feedback

You are responsible for content that you or your users upload, submit, publish, or otherwise make available through Finder. You represent that you have the rights needed to use that content with the service.

If you send us comments, ideas, requests, or suggestions about Finder, you grant us permission to use that feedback without restriction or compensation to you.

Finder may use Sentry or similar third-party error reporting tools to collect diagnostic information, error reports, performance data, and related technical details so we can monitor, debug, secure, and improve the service. Sentry is provided by Functional Software, Inc., and its privacy information is available at https://sentry.io/privacy/.

Acceptable Use

You may not use Finder to violate the law, infringe intellectual property or privacy rights, send spam, store malicious code, interfere with the service, probe or bypass security controls, or misuse the product in a way that harms Finder, other customers, or third parties.

  • Do not upload unlawful, deceptive, infringing, or harmful content
  • Do not exploit, harm, or attempt to harm minors
  • Do not impersonate Finder, a Finder employee, another user, or any other person or entity
  • Do not send spam, junk mail, chain letters, or other unsolicited promotional messages
  • Do not attempt unauthorized access to accounts, systems, or data
  • Do not use bots, scrapers, crawlers, or other automated or manual processes to monitor, copy, or extract materials from Finder without permission
  • Do not reverse engineer or misuse the service beyond permitted use
  • Do not use Finder to build competing datasets or benchmark results without permission
  • Do not upload viruses, malware, trojan horses, logic bombs, or other harmful code
  • Do not attack Finder through denial-of-service, distributed denial-of-service, or similar disruption techniques
  • Do not overload, disrupt, or degrade the service or its supporting infrastructure
  • Do not falsify, manipulate, or damage Finder ratings, reviews, reputation, or performance metrics

AI and Automated Features

Finder may offer search, ranking, summarization, or other AI-assisted features. These features are intended to help users work more efficiently, but automated outputs may be incomplete or inaccurate and should be reviewed before being relied on for business, compliance, or customer-facing decisions.

You remain responsible for how you use any output generated by the service and for validating important actions before acting on them.

Intellectual Property

Finder and its software, design, branding, documentation, and other materials are owned by Finder or its licensors and are protected by intellectual property laws. These terms do not transfer ownership of Finder or its intellectual property to you.

Subject to your compliance with these terms, Finder grants you a limited, non-exclusive, non-transferable right to access and use the service for your internal business purposes during your subscription or permitted access period.

If you believe content on Finder infringes your copyright or other rights, contact us with enough detail for us to review the claim.

Third-Party Services

Finder may allow you to connect third-party services or may rely on third-party providers for hosting, payments, analytics, communications, support, and other product operations.

Third-party services are governed by their own terms and privacy policies. Finder is not responsible for third-party products, websites, services, or content that you choose to use with Finder.

Analytics

Finder may use PostHog or similar analytics providers to monitor and analyze use of the service, understand product performance, improve user experience, detect issues, and make product decisions.

Availability, Changes, and Errors

Finder may modify, update, suspend, or discontinue features from time to time. We will use reasonable efforts to provide advance notice for material changes when practical, but we may make immediate changes for security, legal, or operational reasons.

We do not guarantee that the service will be uninterrupted, error-free, secure, or available in every region or for every use case.

Information on our website, pricing pages, documentation, or inside the product may occasionally contain errors or omissions. We may correct errors, update information, or cancel orders affected by an error where appropriate.

Suspension and Termination

Finder may suspend or terminate access if you violate these terms, create security or legal risk, fail to pay fees when due, or use the service in a way that could harm Finder, other customers, or third parties.

You may stop using the service at any time. Upon termination, your right to use Finder ends, but provisions that by their nature should survive termination will remain in effect.

Disclaimers and Limitation of Liability

Finder is provided on an "as is" and "as available" basis except to the extent otherwise stated in a separate written agreement. To the maximum extent permitted by law, Finder disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Finder will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, or data. Finder's total liability for claims arising out of or relating to the service will not exceed the amounts paid by you to Finder for the service during the 12 months before the event giving rise to the claim.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Finder harmless from claims, damages, liabilities, costs, and expenses arising from your use of Finder, your customer data, your violation of these terms, or your violation of law or third-party rights.

Governing Law

These terms will be governed by the laws specified in any separate written agreement between you and Finder. If no separate agreement applies, these terms will be governed by the laws of the State of Delaware, without regard to conflict of law rules.

Our failure to enforce a provision of these terms is not a waiver of our right to do so later. If a provision is found unenforceable, the remaining provisions will remain in effect.

Changes to These Terms

We may update these Terms of Service from time to time. If we make a material change, we will update the effective date on this page and may provide additional notice through the product or by email.

Your continued use of Finder after the updated terms take effect means you accept the revised terms.

Entire Agreement

These terms, together with the Privacy Policy and any applicable order form, master services agreement, data processing agreement, or program-specific terms, form the agreement between you and Finder for the service.

If a signed agreement conflicts with these online terms, the signed agreement controls to the extent of the conflict.
